Members of RIAJ Sue Japanese ISPs for Disclosure of Users’ Identities

The Recording Industry Association of Japan (“RIAJ”) recently announced that 10 of its member companies have filed suit in Tokyo District Court against two Internet Service Providers (“ISPs”). Claiming that internet users infringed their rights by illegally uploading music files, the plaintiffs sought disclosure of the names and addresses of 11 internet users.
The plaintiffs brought suit pursuant to the Internet Service Provider Responsibility Restraint Law (known as the purobaida sekinin seigen-ho in Japanese). Article 4, Clause 1 of that law requires ISPs to disclose the names and addresses of internet users who infringe the rights of others. The ISPs have refused to disclose the identities of the users without a court order.
